A few simple things to know before we turn your memory into a song.
We want creating your song to be simple, personal and enjoyable. These Terms & Policies explain how the process works, what you can expect from Hear the Memory, and what we ask from you.
By submitting a song request, you acknowledge that you have had the opportunity to review these Terms & Policies. By submitting payment for an accepted song request, you agree to these Terms & Policies.
#1. Your Song Request
Hear the Memory is a review-first custom song service. Every memory and story is different, and we want to be confident that we can create something meaningful from what you share before accepting your project.
Submitting the Start Your Song form allows us to review your story and determine whether Hear the Memory is a good fit for your request. Submitting the form does not create an order, require payment, or obligate Hear the Memory to create a song.
After reviewing your submission, Hear the Memory may accept or decline the request at our discretion. If we accept your request, we will contact you with payment instructions and the next steps.
Your custom song order is confirmed only after Hear the Memory accepts your request and payment is received.
#2. Your Story & Your Information
The best songs come from the details only you know.
You are responsible for providing accurate names, pronunciations, stories, events, relationships, dates, and other details you want reflected in your song. Hear the Memory will create your song based on the information you provide.
You are also responsible for having the right to share any photographs, writings, stories, names, or other materials you submit to us.
By submitting those materials, you give Hear the Memory permission to use them for the purpose of reviewing your request and, if accepted, creating and delivering your custom song.
Your personal story and the original materials you provide remain yours. Submitting them to Hear the Memory does not transfer ownership of your photographs, writings, or other original materials to us.
Hear the Memory is not responsible for inaccuracies resulting from incorrect, incomplete, or unclear information provided by the customer.
#3. Creating Your Song
Once your song request has been accepted and payment received, Hear the Memory will begin creating your custom song using the information and preferences you provided.
Song creation is a creative process. Your finished song will be based on your story, details, and musical preferences, but creative interpretation may be necessary to turn those elements into lyrics and music.
Before music production begins, we will provide your proposed lyrics for review. You are responsible for reviewing them for names, facts, pronunciations, important details, and other information you want corrected or changed.
We will consider your requested lyric changes and work with you toward an approved version before music production begins.
Your approval of the lyrics confirms that the lyrics are ready to move forward into music production. Changes requested after lyric approval are subject to the revision terms described below.
#4. Revisions
After you receive your completed song, one revision is included with your purchase.
Your revision is your opportunity to provide feedback about the completed song and request changes you would like Hear the Memory to consider. Because changes to lyrics, music, vocals, arrangement, or production may affect other elements of the song, not every requested change can be guaranteed.
If Hear the Memory makes an error involving information that you provided correctly and that remained correct in the lyrics you approved, we will correct that error and it will not count as your included revision.
Changes requested because information provided by the customer was incorrect, incomplete, or unclear are not considered errors by Hear the Memory.
Requests made after your included revision, or requests involving substantial changes to previously approved lyrics or musical direction, may require an additional charge. We will advise you of any additional charge before performing that work.
#5. Payment, Cancellations & Refunds
No payment is required to submit a memory for review.
If Hear the Memory agrees to create your song, you will be provided with payment instructions. You are under no obligation to proceed.
Once payment is received, your custom song order is confirmed and payment is non-refundable.
Each song is created specifically from the story, details and preferences you provide. Your purchase includes the lyric-review and revision process described in these Terms.
A customer's failure to respond to requests for lyric review, approval, revision feedback, pronunciation assistance, or other information needed to complete the song does not cancel the order or create a right to a refund.
If Hear the Memory determines that it cannot fulfill a paid order for reasons attributable to Hear the Memory, we may cancel the order and issue a refund.
Music is subjective, and individual reactions will vary. Personal musical preference or dissatisfaction, by itself, does not create a right to a refund.
#6. Your Finished Song
Your custom song is provided for your personal use and enjoyment. You may download and save your song, play it for family and friends, and share it through your personal social media accounts.
Your purchase does not include the right to sell, license, commercially distribute, use in advertising, or otherwise use the song for commercial purposes.
If you would like to use your song for a business, advertisement, commercial project, or another purpose beyond personal use, please contact Hear the Memory before doing so. Any commercial use requires separate written permission from Hear the Memory and may be subject to additional terms and fees.
#7. Sharing Your Song
Your memories may be personal, and we respect that.
Hear the Memory will not publicly share your custom song, story, photographs, personal details, or other materials you provide without your permission.
If we would like to feature your song, story, review, or testimonial on our website, social media, advertising, or other promotional materials, we will ask for your permission first.
Giving or withholding that permission does not affect your purchase, the creation of your song, or the service you receive.
If permission is granted, you may later ask Hear the Memory to stop using your material in future promotional use. This may not allow us to retrieve or remove material that has already been distributed, shared, printed, reposted by others, or otherwise placed beyond our reasonable control.
#8. Technology & the Creative Process
Hear the Memory uses a combination of human creative direction and digital tools to create custom songs.
Technology may assist with portions of the writing, music, vocal, and production process. Each project is developed from the memories, details, preferences, and direction you provide and is reviewed and shaped throughout the creative process.
By purchasing a custom song, you understand and agree that digital and artificial-intelligence-based tools may be used in creating your finished song.
The use of these tools does not change the revision process, customer service, or other commitments described in these Terms & Policies.
#9. Privacy
We collect information you voluntarily provide when you submit a form, contact us, or purchase a song. This may include your name, email address, story details, photographs, and other information or materials you choose to share.
We use this information to review your request, communicate with you, create and deliver your song, process your order, provide customer service, and operate Hear the Memory.
Hear the Memory does not sell, rent, or give away your personal information to third parties for their own use.
Information may be shared with or processed by service providers and digital tools only as reasonably necessary to operate Hear the Memory, process payments, communicate with you, and create or deliver your song.
Payment information is processed through our payment provider. Hear the Memory does not directly store your complete credit or debit card information.
We take reasonable steps to protect the information entrusted to us, but no website, email system, or electronic method of storing or transmitting information can be guaranteed to be completely secure.
#10. Ready-Made Song Purchases
Songs offered for individual purchase on the $1.99 Songs page are existing, finished recordings and are separate from our custom memory-song service.
Your purchase is for a personal-use digital copy of the selected song. Purchasing a ready-made song does not transfer ownership, copyright, or commercial-use rights.
Because these are digital products delivered after purchase, sales are final once the song has been delivered. If you receive the wrong song or experience a problem with your download, please contact us and we will make it right.

We would rather answer a question before your order begins than have you uncertain about what to expect.
